Restaurant Terms

These Restaurant Terms (“Terms”) apply to you if you create an account, onboard, or use the Rabbit Dashboard and related services provided by Rabbit Foods trading as Rabbit (“Rabbit”, “we”, “us”, “our”) to create and manage an online ordering page and receive orders from your customers (the “Services”).

2. Eligibility and your account

You must be a UK-based restaurant or food business (or authorised representative) and have authority to enter into these Terms on behalf of your business.

You are responsible for keeping your login credentials secure and for all activity on your account. You must keep your business information accurate and up to date.

3. Your relationship with customers

Unless we clearly state otherwise in writing, you (not Rabbit) are the seller of the food/drink to your customers and are responsible for preparing, supplying, and fulfilling orders (including delivery using your drivers where offered, or enabling collection).

You are responsible for customer service, handling complaints, refunds, substitutions, order corrections, and compliance with consumer protection obligations that apply to your sales.

4. Restaurant compliance (food, allergens, delivery)

You must comply with all laws and codes that apply to your business and your sales to customers, including UK food safety and food information requirements and any applicable local authority requirements.

  • Allergens: You are responsible for providing accurate allergen and ingredient information and for ensuring your staff can answer allergen queries.
  • Food hygiene: You are responsible for maintaining appropriate hygiene standards and required registrations/approvals.
  • Delivery/collection: If you offer delivery, you are responsible for your drivers, insurance, timing estimates, safe transport, and compliance with any applicable rules.
  • Age-restricted items: If you sell alcohol or other restricted products, you are responsible for licensing and for age-verification procedures at collection/delivery.

You must not list or sell prohibited or illegal items through the Services. We may remove content or suspend access where we reasonably believe you are not compliant.

5. Menus, pricing, and content

You are responsible for your menu content, item descriptions, prices, availability, photos, and any claims (including dietary, allergen, or promotional claims). You must ensure they are accurate and not misleading.

You grant Rabbit a non-exclusive, worldwide, royalty-free licence to host, display, and use your content and branding for the purpose of providing and marketing the Services (including showing your ordering page to customers).

6. Payments, Stripe, refunds, and chargebacks

We use Stripe (including Stripe Connect, where applicable) to process customer payments and facilitate payouts. Stripe may require you to provide information to onboard and may apply its own terms.

You are responsible for refund decisions and customer disputes for orders you fulfil, unless we agree otherwise in writing. Chargebacks and payment disputes may result in amounts being withheld or reversed, and may create a negative balance that you must repay.

We do not store full card details. Payment processing, fraud checks, and payout timing are influenced by Stripe and your configuration.

7. Fees and billing

Fees payable by you for use of the Services (including any per-order fee) will be shown in your Dashboard, onboarding flow, or written agreement with us. Fees may vary by plan, promotional period, location, or agreed discount.

We may change our fees and/or introduce new fees in the future. Where feasible, we will provide reasonable notice via the Dashboard or email before changes take effect. If you do not agree to a fee change, you may stop using the Services.

You are responsible for any taxes on your sales to customers and for your own business taxes. If you become VAT registered, you must provide us with your VAT number and comply with invoicing requirements.

8. Availability, changes, and support

We aim to keep the Services available and secure, but we do not guarantee uninterrupted operation. We may modify, suspend, or discontinue parts of the Services (including features and integrations).

9. Data protection

Each party is responsible for complying with UK GDPR and the Data Protection Act 2018. You are responsible for providing any required notices to your customers and handling their rights requests in relation to your processing.

We process personal data as described in our Privacy Policy. Where we process personal data on your behalf as a processor (if applicable), we will make a data processing addendum available on request.

10. Termination and suspension

You may stop using the Services at any time. We may suspend or terminate your access immediately if we reasonably believe you have breached these Terms, committed fraud, pose a security risk, or are acting unlawfully.

On termination, you remain responsible for outstanding fees, chargebacks, refunds, and any obligations that should reasonably continue.

11. Liability

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under law (including for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence).

Subject to the paragraph above, to the maximum extent permitted by law, Rabbit is not liable for: (a) your sales to customers, (b) food safety, allergens, quality, fulfilment, delivery, or customer service, or (c) indirect or consequential loss, loss of profits, revenue, goodwill, or business interruption.

Subject to the paragraph above, our total liability arising out of or in connection with the Services will not exceed the total fees paid by you to Rabbit in the 3 months before the event giving rise to the claim.

12. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction, except where mandatory law provides otherwise.
